{"id":25298,"date":"2017-01-02T16:13:30","date_gmt":"2017-01-02T16:13:30","guid":{"rendered":"http:\/\/consumerinsight.eu\/marketingisdead\/?p=25298"},"modified":"2017-01-02T16:13:30","modified_gmt":"2017-01-02T16:13:30","slug":"dgccrf-autorite-competente","status":"publish","type":"post","link":"http:\/\/consumerinsight.eu\/marketingisdead\/dgccrf-autorite-competente\/","title":{"rendered":"La DGCCRF est-elle une autorit\u00e9 comp\u00e9tente ?"},"content":{"rendered":"<p>Le 10 novembre 2016, je d\u00e9non\u00e7ais <a href=\"http:\/\/consumerinsight.eu\/marketingisdead\/pratiques-commerciales-trompeuses\/\">ici<\/a> les\u00a0pratiques commerciales trompeuses de la soci\u00e9t\u00e9 Cardata, qui sous couvert d\u2019\u00e9tudes de march\u00e9, se constitue des fichiers de marketing direct et propose toutes sortes de services et de biens en ligne.<\/p>\n<p>Petite expertise du cabinet de mon ami G\u00e9rard Haas en DM sur Twitter\u00a0: <em>\u00ab\u00a0Si la description que vous en faites est av\u00e9r\u00e9e, il convient effectivement de s\u2019interroger d\u2019une part, sur le fondement l\u00e9gal de ce sondage pr\u00e9sent\u00e9 sous forme de jeux-concours et d\u2019autre part sur le traitement des donn\u00e9es \u00e0 caract\u00e8re personnel op\u00e9r\u00e9 par l\u2019organisateur. Les jeux-concours sont r\u00e9gis par l\u2019article L. 121-36 du Code de la consommation lequel dispose que les op\u00e9rations promotionnelles sont licites d\u00e8s lors qu\u2019elle ne sont pas d\u00e9loyales. Le traitement des donn\u00e9es \u00e0 caract\u00e8re personnel est quant \u00e0 lui principalement soumis \u00e0 la loi du 6 janvier 1978 et au nouveau r\u00e8glement europ\u00e9en du 27 avril 2016 qui entrera en application en mai 2018. Vous \u00eates naturellement libre d\u2019alerter les autorit\u00e9s comp\u00e9tentes afin qu\u2019elles examinent la lic\u00e9it\u00e9 de cette op\u00e9ration\u00a0\u00bb<\/em>.<\/p>\n<p>Les autorit\u00e9s comp\u00e9tentes\u00a0: j\u2019envoie donc le 11 Novembre un message \u00e0 la DGCCRF qui me r\u00e9pond le 28\u00a0que c\u2019est \u2026 de l&rsquo;hame\u00e7onnage<em>, \u00ab\u00a0une technique utilis\u00e9e par des fraudeurs pour obtenir des renseignements personnels dans le but de perp\u00e9trer une usurpation d&rsquo;identit\u00e9. Je ne pense pas qu\u2019elle agisse ensuite de mani\u00e8re frauduleuse, comme ceux qui font du Phishing, car elle a pignon sur rue : <a href=\"http:\/\/www.cardata.fr\/\">http:\/\/www.cardata.fr\/<\/a> se pr\u00e9sente clairement comme une soci\u00e9t\u00e9 de marketing direct sur son site institutionnel. Ces pratiques sont honteuses, et contraire \u00e0 l\u2019\u00e9thique de la profession de marketing\u00a0\u00bb<\/em>, en concluant que suis moi-m\u00eame responsable marketing.<\/p>\n<p>Nous sommes d\u00e9but janvier\u00a0: peut-\u00eatre n\u2019aurais-je pas dire que je travaille aussi dans le marketing\u00a0!
